• This Terms of Service (hereinafter, called "TERMS OF SERVICE") is an agreement made by jig.jp co., ltd. (hereinafter called "JIG.JP") to determine use conditions between JIG.JP and the user using an application provided at Android Market (hereinafter called "APPLICATION").
• JIG.JP, subject to the provisions of this TERMS OF SERVICE, hereby grants the user a non-sublicensable and nonexclusive right to install this APPLICATION into a mobile phone (hereinafter called "TERMINAL") and use the APPLICATION.
• By downloading or using this APPLICATION, the user is granted to agree to be bound by all the provisions of this TERMS OF SERVICE. The user is not allowed to download or use this APPLICATION without agreeing the provisions of this TERMS OR SERVICE.

Usage fee of this APPLICATION is free. Communication fee charged for using this APPLICATION is at the user's expense and JIG.JP does not take responsibility for the communication fee.

• The user shall be responsible at his/her own risk and expenses for preparation, acquisition, and configuration of TERMINAL environment required to use this APPLICATION and JIG.JP is not responsible for any damages arising out of the environment to use this APPLICATION.
• Although SSL communication is used between a server of JIG.JP and SSL sites, a ciphered communication other than SSL communication is used between the user’s TERMINAL and a server of JIG.JP. This APPLICATION shall not be used when access a web site requiring high security such as a site for internet banking.
• JIG.JP may update this APPLICATION without the user's consent. JIG.JP is not responsible for any damages arising out of the update and incurred by the user. This TERMS OF SERVICE is also applied to the updated version of this APPLICATION.

• The user shall previously agree to provide opinions, comments and ideas for improvement and to answer questionnaires on the use of this APPLICATION.
• The user shall agree that JIG.JP can use information obtained in accordance with the preceding paragraph for business purposes of JIG.JP including product development.
• Copyrights (including the rights provided for in Articles 27 and 28 of Japanese Copyright Act) and other intellectual property rights relating to the information that JIG.JP obtained from the user are assigned to JIG.JP at no charge at the time when the user provides the information to JIG.JP.
• The user shall not exercise the moral rights of an author relating to the information defined in the preceding paragraph against JIG.JP.

JIG.JP shall manage personal information obtained from the user according to the privacy policy of JIG.JP, unless otherwise provided.

The user is prohibited to perform acts as herein provided and other acts likely to perform the acts when using this APPLICATION.

• (1) To infringe upon the copyrights and other intellectual property of JIG.JP or a third party
• (2) To damage life, body, property, the good name, reputation, privacy and so on of JIG.JP or a third party
• (3) Criminal acts
• (4) To invite others to join pyramid schemes
• (5) To distribute a harmful program such as a computer virus
• (6) Sabotage for a server operated and managed by JIG.JP
• (7) To make an impact on a service or a network system operated by JIG.JP
• (8) To technically analyze or modify this APPLICATION
• (9) To copy or distribute this APPLICATION
• (10) To assign or lease this APPLICATION
• (11) To infringe upon the law or socially acceptable behavior
• (12) Any other acts deemed to be unsuitable for JIG.JP

• JIG.JP may terminate the provision of this APPLICATION or the usage of this APPLICATION by the user for its own discretion.
• JIG.JP may terminate the use of this APPLICATION by the user when JIG.JP deems that the user is not suitable to use this APPLICATION.
• JIG.JP does not take any responsibilities for any damages incurred by the user due to any acts defined in the preceding paragraphs.

This APPLICATION is a sample and beta version. JIG.JP provides this APPLICATION "as is" basis without warranty of the contents, performance, and safety of this APPLICATION. JIG.JP does not take any responsibilities for any risks or loss arising by using of this APPLICATION caused by the user.

• The user shall use this APPLICATION on his/her responsibility and JIG.JP is not responsible for any damages arising out of the use of this APPLICATION and incurred by the user.
• JIG.JP is not responsible for any damages or loss arising out of the inability to use this APPLICATION.
• In the event of a dispute with a third party arising out of the use of this APPLICATION by the user, the user shall solve the dispute at his/her own expense and responsibility and JIG.JP does not take any responsibilities.
• In one of the events specified below, JIG.JP may suspend the provision of this APPLICATION without giving notice to the user. JIG.JP does not take any responsibilities for any damages arising out of the suspension and incurred by the user.
  

   

  • (1) If a server or a system relating to this APPLICATION undergoes maintenance, inspection, or failure.
  • (2) If natural disasters, communication line failure or other unavoidable circumstances occur.
  • (3) Under any other circumstances in which JIG.JP deems a suspension of the provision of this APPLICATION are required.

Intellectual property rights such as copyrights and any other rights relating to this APPLICATION shall belong to JIG.JP or the original owner and the user shall not use a trademark, logo, or service name of JIG.JP without the prior consent of JIG.JP.

If the user breaches the TERMS OF SERVICE or makes any illegal or improper acts by using this APPLICATION, JIG.JP may terminate the use of this APPLICATION and may claim compensation for any damages incurred by the user. JIG.JP may claim compensation for any kind of damages, including direct and general damages, as well as lost earnings, loss of business opportunities, loss of data, business interruption, and other indirect, consequential and incidental damages.

• JIG.JP may amend all or a portion of this TERMS OF SERVICE without giving any advance notice to the user.
• In the case of amendment of this TERMS OF SERVICE, the user is granted to agree the amendment by using this APPLICATION after JIG.JP displays the amended TERMS OF SERVICE on this site unless otherwise provided.

• This TERMS OF SERVICE shall be construed and applied in accordance with the laws of Japan.
• The Japanese version of this TERMS OF SERVICE shall be deemed as the original and the other language versions are the translated versions. The user agrees that only the original is legally binding.
• In the event of a dispute relating to this TERMS OF SERVICE, the exclusive jurisdiction court of first instance shall be the Tokyo District Court or Tokyo Summary Court depending on the jurisdictional amount.

• この利用規約（以下「本利用規約」とします）は、株式会社jig.jp（以下「jig.jp」とします）がAndroid Marketで提供するアプリケーション（以下「本件アプリ」とする）を使用するユーザとjig.jpとの間における使用条件について定めた契約です。
• jig.jpは、ユーザが本利用規約の条項を順守することを条件として、ユーザが本件アプリを携帯電話（以下「端末」とします）にインストールして使用する再許諾不能の非独占的な使用権を許諾します。
• ユーザは、本件アプリをダウンロードしまたは使用することにより、ユーザは本利用規約の全ての条項に拘束されることを承諾したものとみなします。ユーザは、本利用規約の条項に同意しなければ、本件アプリをダウンロードまたは使用することができません。

本件アプリの利用料金は、無料です。なお、本件アプリを使用することによって発生する通信料は、ユーザの負担となり、jig.jpは一切負担及び責任を負いません。

• ユーザが本件アプリを使用するにあたって必要となる端末の使用環境については、ユーザ自身で整備するものとし、jig.jpは、本件アプリの使用環境によって生じるいかなる損害についても責任を負いません。
• jig.jpのサーバとSSLサイト間はSSL通信となっていますが、ユーザの端末とjig.jpのサーバとの間はSSL通信以外の暗号化通信を使用しております。インターネットバンキング等高いセキュリティが必要なウェブサイトをご使用になる場合には、本件アプリを使用しないでください。
• jig.jpは、ユーザの同意を得ることなく、本件アプリをアップデートする場合があります。jig.jpは、アップデートによってユーザに損害が生じても、一切責任を負わないものとします。なお、アップデート版についても、本利用規約の内容が適用されます。

• ユーザは、本件アプリを使用したご意見、ご感想または改善案やアンケートをjig.jpに提供することにあらかじめ同意するものとします。
• 前項に基づいてjig.jpが取得した情報を、jig.jpが製品開発を含むjig.jpの事業目的のために使用できることにユーザは同意するものとします。
• jig.jpがユーザから取得した情報の著作権（著作権法第27条、28条の権利を含む）その他の知的財産権は、ユーザからjig.jpへ情報が提供された時点で譲渡されるものとし、それについて対価は発生しないものとします。
• ユーザは、前項の情報について、著作者人格権をjig.jpに対して行使しないものとします。

ユーザから取得した個人情報は、特段の定めがない限り、jig.jpのプライバシーポリシーにしたがって管理させていただきます。こちらをご覧ください。

ユーザは、本件アプリを使用するにあたり、以下の行為（おそれがある行為を含む）を行ってはならないものとします。

• (1) jig.jpまたは第三者の著作権等知的財産権を侵害する行為
• (2) jig.jpまたは第三者の生命、身体、財産、名誉、信用、プライバシー等を侵害する行為
• (3) 犯罪行為
• (4) 無限連鎖販売取引等への勧誘行為
• (5) コンピューターウィルス等有害なプログラムを頒布する行為
• (6) jig.jpが管理・運営しているサーバへの妨害行為
• (7) jig.jpが運営しているサービスやネットワークシステムに支障を与える行為
• (8) 本件アプリを技術的に解析・改変する行為
• (9) 本件アプリを複製または頒布する行為
• (10) 本件アプリを譲渡または貸与する行為
• (11) 法令または公序良俗に違反する行為
• (12) その他、jig.jpが不適当と判断する行為

• jig.jpは、本件アプリの提供またはユーザーが本件アプリを使用することを自己都合により終了することができるものとします。
• jig.jpは、ユーザが本件アプリを使用することが不適当と判断した場合、jig.jpはユーザの本件アプリの使用を停止することができるものとします。
• jig.jpの前各項の行為により、ユーザに何らかの損害が発生したとしても、jig.jpは一切責任を負わないものとします。

本件アプリは、試用品であり、β版です。jig.jpは、本件アプリを現状のままで提供し、本件アプリの内容、性能、安全性等について、一切保証しません。本件アプリを使用することから生じる危険または不利益は、すべてユーザが負担するものとし、jig.jpは一切責任を負わないものとします。

• ユーザは、自己の責任において本件アプリを使用するものとし、ユーザが本件アプリを使用することによって被ったいかなる損害についても、jig.jpは一切責任を負わないものとします。
• ユーザが、本件アプリを使用できないことによって発生した損害や不利益について、jig.jpは一切責任を負わないものとします。
• ユーザが本件アプリを使用することで第三者と紛争が生じた場合には、ユーザの費用と責任でこれを解決するものとし、jig.jpは一切責任を負わないものとします。
• jig.jpは、以下の事由がある場合には、ユーザへの告知なしに、本件アプリの提供を中断する場合があります。jig.jpは、これに起因するユーザが被った損害に関し、いかなる責任も負わないものとします。
  

   

  • (1) 本件アプリにかかるサーバやシステムの点検、保守または障害があった場合
  • (2) 天災、通信回線の故障等の不可抗力があった場合
  • (3) その他、jig.jpが本件アプリの提供の中断が必要と判断した場合

本件アプリに関する著作権等知的財産権、その他一切の権利は、jig.jpまたは原権利者に帰属するものとし、ユーザは、jig.jpの事前の承諾なくして、jig.jpの商標、ロゴまたはサービス名称を使用してはならないものとします。

ユーザが本利用規約に違反しまたは本件アプリを使用して違法・不正な行為を行った場合には、jig.jpは、ユーザの本件アプリの使用を停止するとともに、jig.jpが被った損害について、損害賠償を請求できるものとします。なお、jig.jpが損害賠償を請求できる範囲は、直接的損害及び通常損害のみならず、逸失利益、事業機会の喪失、データの喪失、事業の中断、その他間接的、派生的または付随的損害の全てを含むものとします。

• jig.jpは、ユーザに事前の通知をすることなく、本利用規約の全部または一部を改定することができるものとします。
• 本利用規約の改定を行った場合には、別途定めがある場合を除き、jig.jpが改定後の規約を本サイト上に表示した後、ユーザが本件アプリを使用した場合には、ユーザは本利用規約の変更内容に同意したものとみなします。

• 本利用規約は、日本国の法律に準拠して解釈・適用されるものとします。
• 本使用規約は、日本語版を原本とし、その他の言語で書かれている利用規約は翻訳版とします。ユーザは、原本のみが法的な拘束力を有することに同意します。
• 本利用規約に関して紛争が生じた場合には、訴額に応じ、東京地方裁判所または東京簡易裁判所を第一審の専属的管轄裁判所とします。
